Terms of Service

These Terms of Service (“Terms”) govern your use of newportexchange.org and the Newport Exchange API (together, the “Service”), operated by Newport Exchange (“we”, “us”). By using the Service you agree to these Terms. If you use it on behalf of an organisation, you confirm you are authorised to accept them for that organisation. If you do not agree, do not use the Service.

The Service provides cryptocurrency market information, including prices, market capitalisation, trading volume and supply for the largest cryptocurrencies by market capitalisation, daily price history, news aggregated from third-party publishers and research articles, on the website and through a REST API. Data is refreshed periodically and is not real-time. We may change, suspend or discontinue any part of the Service at any time.

Everything on the Service is provided for general information only. It is not investment, financial, trading, legal or tax advice, and it is not a recommendation or offer to buy, sell or hold any asset. We are not a broker, exchange or investment adviser, and you cannot trade on the Service.

Cryptocurrencies are highly volatile and you can lose all of the money you put into them. Do your own research and consider consulting a qualified professional before making any financial decision. You are solely responsible for your decisions.

Market data comes from third-party providers and may be delayed, incomplete or inaccurate. Some values, such as intraday highs and lows for the current day, are estimated from periodic snapshots. News content is written by third parties and we do not verify it. We do not guarantee that the Service will be accurate, complete, timely or available without interruption, and you should not rely on it as your only source of information.

Some API endpoints require an API key, which we issue at our discretion. The API documentation forms part of these Terms. If you use the API:

• Keep your key confidential, use it only from server-side code you control, and do not share, sell or publish it. You are responsible for all use of your key.
• Stay within the rate limits that apply to your key or to public endpoints, and do not try to get around them, for example by using several keys or IP addresses.
• You may use API data inside your own applications and services. You may not resell, sublicense or redistribute the data in bulk, or use it to build a competing market-data feed or API.
• Where you display our data or news to others, credit Newport Exchange as the source and keep attribution to the original publishers.

We may change the API, change rate limits, or suspend or revoke any key at any time, including if we believe it has been misused or compromised. The API is provided free of charge and without any service-level commitment unless we agree otherwise in writing.

You agree not to:

• break the law or infringe anyone’s rights while using the Service;
• probe, scan or test the vulnerability of the Service, or bypass authentication, rate limits or other security measures;
• disrupt or overload the Service, including through automated requests that ignore our robots.txt or rate limits;
• introduce malware or attempt to access data or accounts you are not authorised to access;
• misrepresent your identity or your affiliation with us.

Search engines and AI crawlers may index the website in line with our robots.txt.

News articles, images and research articles belong to their respective publishers and authors. Links to third-party websites are provided for convenience; we do not control and are not responsible for those websites or their content. If you believe content on the Service infringes your rights, contact us at [email protected] with details and we will review it promptly.

The Service, including its design, software, text and the Newport Exchange name and logo, is owned by us or our licensors and protected by intellectual property laws. Apart from the limited rights in these Terms, including the API rights above, we grant you no rights in it. Cryptocurrency names and logos belong to their respective owners.

The Service displays advertising, including ads served by Google. We do not endorse the products or services advertised, and any dealings with advertisers are solely between you and them. See our Privacy Policy for how advertising cookies work and how to opt out.

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, trading losses, loss of data or loss of goodwill, arising from or related to your use of, or inability to use, the Service or any data or content on it, even if we were advised of the possibility of such damages.

Our total liability for any claim relating to the Service will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

You agree to indemnify and hold us harmless from claims, losses and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Service, including misuse of your API key.

We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed, and continuing to use the Service after a change means you accept the updated Terms. We may suspend or end your access to the Service, including any API key, at any time if you breach these Terms. The sections on data accuracy, third-party content, intellectual property, disclaimers, limitation of liability and indemnity continue to apply after your use ends.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy and the API documentation, are the entire agreement between you and us about the Service.
